Brit's lawyer talks speaks on custody ruling

Britney Spears temporarily lost custody of her kids because she was accused of not taking
a random drug and alcohol test and she couldn't provide a valid California Driver's license,
her lawyer tells People.com.

After a closed door hearing Monday, a judge granted Kevin Feterline physical custody of
Sean Preston, 2, and Jayden James, 1, "until further order of the court." L.A Superior Court
Commissioner Scott Gordon didn't outline his reasons in the written ruling, but Spears's
attorney, Sorrell Trope, says, "We weren't able to prove compliance with what the judge
ordered."

"Specifically," Trope says, "the judge ordered that by 10 a.m (Monday morning), both
parties show a valid California driving licences. I've been unable to produce evidence of
that."

Spears, facing a misdemeanour charge of driving without a license, went to the Department
of Motor Vehicles on Monday to get a California license to replace her Louisiana card, but
DMV spokesperson Jan Mendoza says, Spears hasn't yest finished the application process.
"As of now, she's not legally able to drive in California," says Mendoza.

Trope says another reason behind the judge's temporary custody ruling "was a claim by Mr.
Federline's attorney that she had not complied with a previous order the court had
made...about having a random drug and alcohol test"

Trope adds: "There's no evidence that she actually failed a test."

However, the courts see the failure to take a test as the same thing as not passing the test.

Meanwhile, Spears is "very optimistic" she'll get her sons back as she completes the
judge's checklist, the singer's close friend Sam Lufti says.

Federline's attorney declined to comment, but a course close to Federline says he was
"thrilled" about the temporary custody change. Another hearing is scheduled for today.

Pregnant Berry won't wed Gabriel Aubry

Halle Berry says she was meant to be a mother - but the 41-year-old expectant mom had a tough time getting there, People.com reports. "After about 35 tests, we finally got a positive test," Berry said on the Oprah Winfrey Show yesterday.

Meanwhile, Berry says she has no plans to wed boyfriend Gabriel Aubry: "What Gabriel and I have decided is that we will just redefine marriage for ourselves."

Cameron Diaz and her latest fling, actor Bradley Cooper, spent a romantic New York weekend together, PageSix.com reports.

The dined at Asia de Cuba at Morgans Hotel Saturday night and then hit the SNL after-party at Primehouse on Park Avenue South. One onlooker told us the twosome "were very close and lovey. Something is definitely going on, and it's clear they are more than just friends."

They were also spotted on the sideline of the Giants game on Sunday, along with team owner Steve Tisch, Demi Moore and Ashton Kutcher.

Kevin Feterline awarded custody of his 2 children

It's official. Britney Spears ex husband, Kevin Feterline, has been awarded sole physical custody of their 2 children. This should be a wake up call for Britney to change her lifestyle and focus on herself and her children.

Lohan to stay in rehab

Lindsay Lohan will not be checking out of the Cirque Lodge rehab program anytime soon. People.com had speculated that she would be released this past weekend. "Not true," the actresses mother, Dina Lohan, 45, told Access Hollywood in an email, she's "staying in Utah."

A source close to the star also says "Lindsay is not leaving Cirque Lodge in Utah anytime soon. She has a few more weeks to grow and develop, and she is doing great."

Lindsay's treatment in rehab began last month, following her early morning July 24th arrest in Santa Monica, Calif., on suspicion of drunk driving after a brief car chase.

Pamela Anderson and Denise Richards posing together on Playboy?

Pamela Anderson and Denise Richards are considering a $1 Million US offer to pose nude together in an upcoming issue of Playboy magazine, imdb.com reports.

Both blondes have posed for Playboy in the past, and now Playboy boss Hugh Hefner wants the acresses to pose together in the January 2008 Issue of the magazine.

A source tells the Globe, "Neither Pam nor Denise has committed yet, but they're seriously considering it". Pam Anderson has appeared nude in Playboy a record 12 times, and whil Denise Richards stripped for the December 2004 issue.

Michael Jackson Married?

Michael Jackson has secretly married his children'snanny, imdb.com reports.

Depsite denials from the superstar's camp. The National Enquirer has printed copies of a new real estate document, in which Jackson states he's married.Sources close to the King of Pop have confirmed Jackson married 40 year old Grace Rwaramba in Las Vegas earlier this year.

A source tells the Enquirer, "Grace is one of his dearest friends. She is one of the few people who stood by his side through all of his problems.

If true, this is Jackson's third marriage. He was peviously married to Debbie Rowe and Lisa Marie Presley.

Vivica pleads not guilty

Vivica A. Fox pleaded not guilty to two misdemeanor counts of DUI in Van Nuys, Calif., courthouse Thursday September 27th, People.com reports.

A police car noticed Fox's silver Cadillac SRX speeding on a Los Angeles Freeway, and was unable to stay in her lane.

If convicted on both charges, Fox faces a maximum of six months in jail and a $1,000 fine.
